Agreement to Terms

By accessing or using Chahiya's website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. Chahiya is a software-as-a-service (SaaS) platform for restaurant management, operated by an independent developer.

Description of Service

Chahiya provides a digital platform that enables restaurant owners and food entrepreneurs to manage their menus, orders, team members, and customers. The platform is accessible via web browser at app.chahiya.com. Chahiya is a tool provider - we are not a party to any transaction between tenants (restaurant owners) and their end customers.

User Accounts

To use certain features of Chahiya, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration.

Tenant Responsibilities

As a tenant (restaurant owner or operator), you are solely responsible for:

• The accuracy of your menu content, pricing, and product descriptions.
• Compliance with local food safety, health, and business regulations in your jurisdiction.
• The relationship with your end customers, including order fulfillment, customer service, and dispute resolution.
• Ensuring that your use of Chahiya complies with all applicable laws.

Intellectual Property

Chahiya owns all rights, title, and interest in the platform, including its software, design, branding, and documentation. Tenants retain full ownership of their data, including menu content, customer data, order history, and analytics generated from their use of the platform. You may not copy, modify, distribute, or reverse-engineer any part of the Chahiya platform.

Service Availability

Chahiya does not guarantee 100% uptime, particularly during the early access period. We will make reasonable efforts to maintain service availability and will communicate any planned maintenance in advance. We are not liable for temporary service interruptions due to maintenance, updates, or circumstances beyond our control.

Payment and Billing

Access to Chahiya's paid features requires a subscription. Payment terms, including pricing and billing cycles, will be communicated at the time of subscription. All fees are non-refundable except as specified in our Refund Policy.

Termination

Chahiya may suspend or terminate your account if you violate these Terms of Service, engage in fraudulent activity, or use the platform in a way that harms other users or the service. You may also terminate your account at any time by contacting us. Upon termination, your data will be handled in accordance with our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by law, Chahiya's total liability for any claims arising from or related to these terms or the use of our services is limited to the total fees you have paid to Chahiya in the 3 months immediately preceding the event giving rise to the claim. Chahiya is not liable for indirect, incidental, special, consequential, or punitive damages.

Changes to These Terms

We may update these Terms of Service from time to time. When we make changes, we will provide at least 30 days' notice via email to the address associated with your account. Your continued use of Chahiya after the notice period constitutes acceptance of the updated terms.
